I think though where Mr. Kilby, trying to be a nice man, has gone wrong is in his desire not to file a lawsuit. Unfortunately, a lawsuit is the only way to get anyone's attention these days. And if he doesn't want the money, he then should claim that all proceeds from the lawsuit will go to x and/or y charity. But you can be sure, he'll get attention.
Take a look at all the circumstances. Yes, the case is a few years old -- but the pain is fresh and will remain so unless there is closure. If you can help the Kilby family in any way, please do so. At the end of Mr. Kilby's blog is a list of things that can be done. But my strong recommendation Arnold is that you seek assistance to file a lawsuit and begin proceedings unless the statute of limitations has set in.
If it has, then the only thing we can do is hope that others do indeed file lawsuits as soon as they believe something is wrong.
